Freedom of Information Act 2000 – Request for Information

We are pleased to respond to your request for information and our response is set out below:

Request/ Response

Our request relates to claims pursued for retrospective NHS funded continuing healthcare claims and the calculation of redress. We require information held from 2012 to 2019.

In respect of the claims, please provide us with the following information:

1. Guidance, internal memorandums, internal policies or information in calculating redress, the amount to be reimbursed when retrospective NHS Continuing Healthcare is found?

The CCG follows the redress guidance issued by NHS England on 01/04/2015. This document is available to the public at

2. Guidance, internal policies and minutes of any meetings regarding the calculation of interest to provide redress for retrospective NHS Continuing Healthcare claims;

Other than the guidance referred to above, there is no other CCG guidance or internal policies and no meetings have been held regarding the calculation of interest to provide redress.

3. Guidance, information, minutes of meetings and internal policies on the 20% tax deducted as a result of HMRC  

The CCG has received guidance from NHS England regarding the deduction of tax from redress payments. However, as far as we are aware, this guidance is not available publicly. NHS England is currently in discussion with HMRC regarding this issue and it is possible, therefore, that the guidance issued to CCG’s contains information that is sensitive. As such, we suggest that this request is directed to NHSE.
